Terms of Service

1. Acceptance of Terms

By accessing or using ScriptForge ("the Service"), operated by Simakk Digital ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ScriptForge is an AI-powered platform for creating short-form video content. The Service includes script generation, voice synthesis, B-roll sourcing, caption styling, and video rendering. Features vary by subscription tier.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to use the Service.

4. Subscription and Billing

  • Paid plans are billed monthly or yearly through our payment processor.
  • Your subscription renews automatically unless cancelled before the renewal date.
  • Prices are listed in US Dollars (USD) and may change with 30 days notice.
  • A free tier is available with limited features — no credit card required.

5. BYOK (Bring Your Own Key)

You may provide your own API keys for third-party services (OpenAI, ElevenLabs, Pexels, etc.). Your keys are encrypted at rest and used solely to process your requests. We do not store, share, or use your API keys for any other purpose.

6. Content Ownership

  • Your content: You retain ownership of all scripts, audio, and videos you create using the Service.
  • AI-generated content: Scripts generated by AI are provided for your use. You are responsible for reviewing and modifying AI output before publishing.
  • B-roll media: Stock media sourced through the Service is subject to the licensing terms of the respective provider (Pexels, Pixabay, etc.).

7. Acceptable Use

You agree to abide by our Acceptable Use Policy, which covers content guidelines, AI-generated content disclosure, and prohibited activities in detail. In summary, you agree not to:

  • Use the Service to create illegal, harmful, or misleading content.
  • Create deepfakes, impersonation content, or non-consensual synthetic media.
  • Attempt to reverse-engineer, exploit, or overload the Service.
  • Share your account credentials or resell access to the Service.
  • Use the Service to generate spam or manipulate platform algorithms.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible. We are not liable for interruptions caused by third-party services (AI providers, payment processors, etc.).

9. Limitation of Liability

To the maximum extent permitted by law, ScriptForge and Simakk Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of your billing period.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the courts of South Africa.
